On behalf of Human Rights Watch, I write in concern over a climate that increasingly threatens the basic rights and equality of lesbian, gay, bisexual, and transgender people in Poland.

As you are undoubtedly aware, on January 18 the European Parliament overwhelmingly passed a resolution condemning “a series of worrying events” in member states, “ranging from banning gay pride or equality marches to the use by leading politicians and religious leaders of inflammatory or threatening language or hate speech, failure by police to provide adequate protection or even breaking up peaceful demonstrations,” as well as “violent demonstrations by homophobic groups.”

The European Parliament urged member states “firmly to condemn homophobic hate speech or incitement to hatred and violence, and to ensure that freedom of demonstration—guaranteed by all human rights treaties—is respected in practice.” It also called on them “to promote and implement the principle of equality in their societies and legal systems.”

Human Rights Watch urges that Poland, as an E.U. member state, through its government and you as President, respond positively, promptly and effectively to this resolution.

This resolution is based on human rights standards to which all European Union member states are bound, including Article 13 of the Amsterdam Treaty, Article 21 of the E.U. Charter of Fundamental Rights, and Directives 2000/43/EC and Directive 2000/78/EC prohibiting direct or indirect discrimination on specific grounds including sexual orientation. It is also based on Poland’s international legal obligations under the European Convention on Human Rights and the International Covenant on Civil and Political Rights.

As president of Poland it is your responsibility to speak in defense of the rights freedoms of all Polish citizens, particularly vulnerable minorities. When government officials contribute actively to stigma against a minority that they are obligated to protect, they signal that discrimination and perhaps even violence will be tolerated. Such statements create a dangerous environment for the freedoms of all..

Human Rights Watch has been monitoring with grave reservations several restrictions placed on the rights of the lesbian, gay, bisexual, and transgender community in Poland over the past number of years. We are aware that you yourself have supported restrictions on that minority’s rights in your prior capacity as mayor of Warsaw, as have members of your party and government in public statements.

In 2004 and 2005, as mayor of Warsaw, you banned Gay Pride marches—a peaceful exercise of the freedom of assembly which had taken place several times in previous years without incident. You declared that you were opposed to “propagating gay orientation.” In 2004, you refused even to meet with the organizing group, the Campaign Against Homophobia—reportedly stating, "I am not willing to meet perverts." On the other hand you approved counter-demonstrations by conservative groups opposed to the march, the League of Polish Families and the All-Polish Youth. In the same year, a “March for Tolerance” organized by the Campaign Against Homophobia in Cracow was attacked by over two hundred demonstrators, many skinheads from the All-Polish Youth, who pelted them with eggs, bottles, and rocks, and shouted "Send the fags to the hospital!" and "Perverts, get out of Cracow!"

In 2005, more than two thousand demonstrators, supported by the deputy prime minister and deputy speaker of the Sejm, defied your ban and marched through Warsaw’s streets, despite attacks from counterdemonstrators. Counterdemonstrators threw eggs and rushed barricades in an attempt to beat marchers. You subsequently condemned the fact that police did not stop the march, but that they tried to stop the attackers. Your official position was that “the police undertook to protect an illegal demonstration by gay and lesbian organizations but drastically attacked other illegal gatherings. This situation constitutes an infringement of the principles of social coexistence.”

Also in 2005, following the example of Warsaw, the mayor of Poznan banned a March for Equality and Tolerance in Poznan—one sponsored not only by the Campaign Against Homophobia but by human rights, women’s, and student organizations. When a small number of marchers persisted in assembling, members of the All-Polish Youth assaulted them, throwing projectiles and shouting “Gas the fags!” and “We’ll do to you what Hitler did to the Jews!” In this case, police intervened against the marchers rather than the attackers, arresting sixty-eight of them.

Since you assumed the presidency, your political allies have continued to make ominous statements threatening state action against the public expression or defense of homosexuality. Prime Minister Kasimierz Marcinkiewicz has told the press that if a homosexual “tries to 'infect' others with their homosexuality, then the state must intervene in this violation of freedom.” Jaroslaw Kaczynski, leader of the Law and Justice Party, and your brother, called during the 2005 election campaign for banning gays and lesbians from teaching. In January 2006, he condemned a situation where “gay people are allowed to conduct perverse demonstrations in the streets, but it is forbidden to discuss the issue of moral censorship.”

We are also concerned by the election by the Sejm, on January 26, of Janusz Kochanowski as Ombudsman for Human Rights. Mr. Kochanowski has stated in the past that "a culture favorable to pedophilia has come to Poland. … This culture already accepts homosexuality and wants it to be seen as equal to heterosexuality. And there is a link between pedophilia and homosexuality: the majority of pedophiles are homosexual."

That statement is untrue. Further, the mentality it reflects--one in which myth and stigma are used to vilify a minority and nullify its right to participate in society--is inimical to Poland’s vibrant democracy. Fears of “infection” and blatant invocations of prejudice cannot be allowed to decide how citizens exercise their rights. Gays and lesbians marching in the streets pose no conceivable threat to other Poles. To suppress their freedoms threatens all people’s equality.

Poland is a long standing party to the European Convention on Human Rights and Fundamental Freedoms. You will thus be aware that Poland is bound to prohibit discrimination on grounds of sexual orientation or gender identity in relation to any of the rights enjoyed under the Convention. The European Court has on several occasions made clear that discrimination based on sexual orientation is strictly prohibited. Most recently in Karner v Austria, the Court pointed out that “very weighty reasons have to be put forward before the Court could regard a difference in treatment based exclusively on the ground of sex as compatible with the Convention. Just like differences based on sex, differences based on sexual orientation require particularly serious reasons by way of justification.” Similarly, the U.N. Human Rights Committee—charged with monitoring states’ compliance with the International Covenant on Civil and Political Rights (ICCPR) –held in 1994 in Toonen v Australia that sexual orientation should be understood as a status protected against discrimination by the treaty’s equality provisions.

Human Rights Watch is deeply concerned that actions that taken against lesbian, gay, bisexual, and transgender people in Poland directly violate these international standards. We therefore urge you to affirm that the rights to expression, association, and assembly cannot be denied on the basis of sexual orientation or gender identity.

In your new capacity as Poland’s president, you stand under the scrutiny of Europe and the international community to see whether you will work to defend or seek to deny human rights protections. With confidence in the power and permanence of Poland’s democratic development, we hope that you will commit yourself to the former.

Its seems a pan Eurpoean call for candidates was put out today by Libertas. Despite the fact that they said they would announce candidates and present them at their rally in Rome on March 25. They are still desperately seeking candidates Polish Polish journalist Dominika Pszczolkowska, the Brussels correspondent for Gazeta Wyborcza, has also blogged about her receipt of an offer to be a Libertas candidate. She was as bemused as this blogger was. I have still heard nothing from Libertas and several hours have passed since I sent them an email to say I would run fro them. With only a few days to go I before the Rome meeting I will be hard pressed to make it unless they decide pronto!

How much did this protest cost Libertas? Who is funding Libertas. Ganley says he is using his own cash so where have they got their cash from. Who is behind this? Who is funding their printing bills?

Their flyer today says that the EU passed more laws than any other single country in the last five years.
Duh.....well it is a collection of 27 countries Ganley. These Libertas people are ignorant of democracy and legislation. They use propaganda like Goebbels and are pushing their own Big Lie. It was defined by Adolf Hitler in his 1925 autobiography Mein Kampf as a lie so "colossal" that no one would believe that someone "could have the impudence to distort the truth so infamously".

For Libertas the attempt to convince people that in Europe that all their elected politicians are "undemocratic" is one plank of their Big Lie. Another is that they say no institution of government is transparent despite the fact that they are secretive in nature and have no policies at all except negitive lie ridden threthoric. Thye have not revealed how they funded their No campaign in Ireland. they have not divulged who is funding their attcks on our democratic institions.

The people of Europe must resist this threat. Wipe out Libertas candidates in June.

The presidents of Hunting, Fishing, Nature and Traditions (CPNT) and the Movement for France (MPF), launched their campaign for European elections. The movements of the two former presidential candidates to go under the banner of Libertas, the party created by the Irish leader.


For the MPF and CPNT, the Libertas campaign will give the finger to the entrance of Turkey into Europe, against which Philippe de Villiers has struggled for several years. For this Libertas demands that the European Parliament imposes a "perimeter of Europe." "We want a Europe that promotes and defends us," says Philippe de Villiers, alluding to the introduction of a system of preference in emigration.
For Declan Ganley, the implementation of the text would lead Europe to a phase of "post-democracy." "So you will lose any opportunity to make your voice heard in Brussels." Dramatizing, the Irishman continued: "Millions of people have shed their blood all over Europe for democracy!"

Frédéric Nihous calls on the EU to establish a "true European environmental policy" calling for "putting people at the heart of the debate." "Stop dreaming! Stop being utopians'," he says. Beyond a willingness to work together, the president of CPNT quickly found other things in common with Ganley, also a hunter. Frédéric Nihous declared "we will hunt in packs."

Although Libertas officially announce the composition of its list in"ten to fifteen days," Philippe de Villiers has confirmed that he would run in the West, and Frédéric Nihous in the Northwest. As for the nomination of Jerome Riviere, director of the French countryside for Libertas, and the head of the list francilienne, is no longer a secret. Patrick Louis should be renewed in the Southeast.

Right-wing parties rally under Libertas banner

JOY IS not an emotion one usually associates with Viscount Philippe de Villiers, the right-wing French politician who has built his career on fear-mongering over the influx of Muslim immigrants and opposition to what he calls the “oligarchs and commissars” of Brussels.

But “joy” was the word Mr de Villiers used to describe the launching of a joint European parliamentary election campaign uniting his Movement for France (MPF) and Frédéric Nihous’s Hunting, Fishing, Nature and Tradition (CPNT) party under the Libertas.eu banner yesterday.

Libertas founder Declan Ganley, whom Mr de Villiers called “our hero”, proudly watched over the ceremony.

Mr de Villiers delivered a romantic version of Mr Ganley’s alleged heroism. “They fobbed a repeat of the constitution on us, and one man rose up, an Irish businessman who won the support of the people.”

Mr de Villiers’s tone veered into sarcasm, his speciality. The good people of Ireland were in for a surprise, he said. “When people vote No, they must be forced to vote again.”

Hence the importance of June’s European elections. Since 26 EU countries were deprived of a vote on Lisbon, “this European election must replace the referendum people didn’t have”.

Mr de Villiers mingled grievances against Europe and President Nicolas Sarkozy. Europe “must draw its borders, once and for all, without Turkey”, he said. He complained that Mr Sarkozy has allowed negotiations on Turkish accession to proceed on 10 of 35 chapters. And Mr Sarkozy did away with a constitutional provision requiring a French referendum on Turkish accession.

Then it was time for a tirade against “the crazy madmen who continue stealing people’s identity and traditions”. Europe was preparing regulations that would make rosé wine by mixing red and white, Mr de Villiers claimed. And Europe wanted to impose health warnings on camembert cheese! Standing beside Mr Ganley, champion of free markets, Mr de Villiers the protectionist pleaded for “European preference, so that Europe can fight outsourcing and the transfer of our means of production to China”.

Still standing beside Mr Ganley, the defence contractor who has just named four former senior defence officials from the US and Britain to the board of his company, Mr de Villiers condemned Mr Sarkozy’s announcement yesterday that he is bringing France back into the integrated military command of Nato. “The return to Nato is the end of the independence of France. It is the end of the very idea of European defence.”

Mr Ganley took the floor, calling France “the beating heart of Europe”. But where Mr de Villiers voiced grievances, Mr Ganley incited them.

If the Lisbon Treaty is ratified, he said, there will never be another referendum.

“The small little bit of power you have will be taken away from you!” Mr Ganley harangued the small crowd of journalists as if they were supporters at a rally. “These elites in Brussels have silenced the French people. They ignored you completely! They point at the people of France and the Netherlands and Ireland and they say, ‘There is something wrong with you. You are ignorant. You are not European.’”

It was time for people to “tell the elites in Brussels, ‘No. There is something wrong with you.’”

Paul-Marie Coûteaux, one of three MEPs elected on Mr de Villiers’s list five years ago, created a storm by denouncing the party’s alliance with Mr Ganley on the eve of the launch.

Mr Coûteaux accused Mr Ganley of supporting the election of a president of Europe by universal suffrage, Turkish accession to the EU and Nato membership for all European states.

Mr Ganley confounded several sources who had the strong impression that he supported Turkey’s EU application and Nato.

“I completely agree on Turkey,” he said. “On the matter of Nato, this is a decision that must be made at member-state level. Ireland is neutral.”

(In an article he published in the US in 2003, Mr Ganley attacked the constitutional treaty on the grounds it would damage the traditional defence relationship between Europe and the US.)

So how much was Libertas contributing to Mr de Villiers’s and Mr Nihous’s European campaigns? “Not one centime!” he protested, denouncing “unhealthy, malignant rumours” and “calumny”. “Not a sou!” added Mr Nihous. When I asked Mr Ganley whether Libertas had offered Swedish party Junilistan €900,000 to campaign under his party’s name, he answered with a sharp “No” and walked away.

France's MPF split over Libertas being too close to NATO and Ganley changing his position

On the day that Libertas launch in France. Phillipe de Villiers' party has split his over allience with Libertas. MEP Paul-Marie Coûteaux has decided to leave MPF which has forged an alliance with Libertas. This is another blow for Ganley as Paul-Marie Coûteaux was one of the 80 people who attended Ganley's Eurosceptic dinner in honour of Vaclav Klaus. Ganley gathered fanatics from the fringes of European politics to form his unique alliance.
Coûteaux recently said that French Justice Minister Rachida Dati was not integrated as she had called her child Zohra. For one eurosceptic the news of Ganley's board appointments of CIA advisor Gen Richard Myers who was Bush's leading military advisor for his invasions of Afghanistan and Iraq. In the UK he was forced to appoint an employee to lead the party, Lt Col Robin Matthews, who is also chef de cabinet for Libertas in Brussels. Last year he was the spokesperson for the British/NATO war effort in Helmand province, Afghanistan. France also has 3000 troops in Afghanistan at present.
In his statement's headline Coûteaux declares "No to the Europe of the crisis, not NATO, not to impotence,Oui à la France ! Yes to France!" . Ganley's close alliance with the US military will win him few friends among hard right nationalists as he rolls out his party. The questions raised by Libertas's offer of one million Euro to a Swedish party may also have caused problems for those who signed up early like Coûteaux. Libertas have been negotiating with different parties across Europe and the amount of backing offered in cash in different countries may be causing jealousy among Ganley's new friends.

Coûteaux refused to allow Ganley to take control of his voting list for Ile de France. he now says he has the support of "friend" in the MPF and 30 federtations to launch a party.
